Leave
Annual Leave
You will be paid for unused annual leave up to 400 hours of the total that were accrued at the end of the previous year, plus the number of hours of annual leave that were accrued during this calendar year and remain unused.
If you return to a regular State position at any time, your previous service will be used to determine your annual leave earning rate.
Personal Leave
Any unused personal leave will be forfeited.
Sick Leave
If you retire from State service directly upon terminating employment, you will receive additional creditable service for your accumulated unused sick leave. Since creditable service determines the amount of your retirement benefit, it may increase the amount of money you will receive each month.
If you separate from State service for reasons other than retirement, your sick leave will be forfeited; however, your balance will be restored if you are reinstated to a regular position in State service within 3 years of separation.
Compensatory Leave
If you are exempt from the overtime pay provisions of the Fair Labor Standards Act (FLSA), you may be paid for up to 16 hours of unused compensatory leave at the time of separation. If you are non- exempt under FLSA (cash overtime eligible - COE), you will be paid for any unused COE compensatory hours.
Financial Disclosure
If you are required to file a Financial Disclosure statement with the Maryland State Ethics Commission, you must submit a statement of termination within 60 days of leaving that position. For more information, please call 410-260-7770 or go to

Health Benefits Information
You and/or your dependents may be eligible to continue your health benefits for a timeframe determined in accordance with federal regulations. For additional information, please contact your Human Resources office, or you may call the Employee Benefits Division at 1-800-307-8283.
Reinstatement
If you separated from State service in good standing and return to a regular position within three years of separation, your unused sick leave balance will be restored. Please be sure to advise your new State agency of your previous employment. You may apply for State positions or be placed on a reinstatement list by visiting

Retirement Benefits
State Pension
If you have completed at least five years of eligibility service and began regular continuous State employment prior to July 1, 2011, you are considered to be vested in the retirement system. This means you will be eligible to collect a retirement benefit at age 62. If you began employment July 1, 2011 or later, you will need to have completed 10 years of eligibility service and be at least 65 years old to collect a retirement benefit. You may be eligible for a reduced benefit at age 55.
If you believe you may be eligible for a disability retirement benefit, you must apply for disability retirement benefits while on payroll or within two years after paid employment ends. If you have been off payroll for more than four years upon filing for benefits, you will not be eligible for benefits unless you can prove that you were mentally or physically incapacitated from filing within the established deadline due to the disability itself.
If you would like information regarding the withdrawal of any contributions that you may have made to the Maryland State Retirement Pension System, please contact your Human Resources office for the necessary forms. Please read the information carefully, as you will be forfeiting your rights to any retirement benefits, including disability, if you withdraw your contributions from your account.
